(CNN Spanish) --
A court in Georgia determined this Thursday that Diego Ibarra will remain in the custody of the United States authorities without the right to bail.
Ibarra faces federal criminal charges for possessing fraudulent US residency documents and if found guilty could be sentenced to up to 10 years in prison.
Diego Ibarra is the brother of the suspect in the death of nursing student Laken Riley, found dead in late February on the University of Georgia campus.

During this Thursday's hearing, a special agent from the United States Department of Homeland Security testified that a gang investigation unit determined that some tattoos on Ibarra's body are related to the symbols of the Venezuelan criminal gang the Tren de Aragua.
Led by Héctor Guerrero, the Tren de Aragua was born in a prison in central Venezuela and has expanded its tentacles in South America and some cities in the United States, according to official reports.

Bryant also detailed that they identified several different social media accounts used by Ibarra in which it can be seen that he makes signs linked to gang members of the criminal organization, and appears portrayed with firearms.
Ibarra's defense team argued, however, that the tattoos and signs are not enough to identify him as a gang member of the Tren de Aragua.
