In January 2024, the KLDJ registered a complaint by

Andrey Sharendy

regarding discrimination against his wife,

Polina Sharendy-Panasyuk,

who was illegally convicted for allegedly insulting government officials and using violence against police officers, and later twice for maliciously disobeying the demands of the colony administration.

Polina is serving her term in a correctional colony and all this time she is in unbearable conditions: she was repeatedly detained in SHIZA and PKT, she was not given transfers (including medical parcels with medicines) and letters, she was not given bed linen, there was no heating in the cells and hot water.

Staying in inhumane conditions had a strong effect on Polina and significantly worsened her health, but the colony administration did not respond to numerous requests to provide her with the necessary medical care.

Since January 8, 2024, there is no communication with Polina: no letters come from her and the lawyer is not allowed to see her.

In this regard, the lawyers of the Respect-Protect-Fulfill organization appealed to the CEDAW with a request to take temporary measures in this case.

The committee agreed with the lawyers' arguments and asked Belarus to "urgently provide Polina Sharendza-Panasyuk with full and proper medical care and create conditions that would help preserve her life, physical and psychological health."

Temporary measures of the CEDAW are mandatory.

Provision of temporary measures in this case is an important step in the development of the practice of the CLDJ in cases against the authorities of Belarus, as this is the first case in the history of work of Belarusians with this mechanism.

  • The UN Committee on the Elimination of Discrimination against Women is an international body that monitors the implementation of the Convention on the Elimination of Discrimination against Women.

Belarus has been participating in this Convention since 1981.

An appeal to the CEDAW is one of the few ways Belarusians can defend their rights in international legal mechanisms.

  • Respect-Protect-Fulfill is a Belarusian independent non-governmental non-profit human rights organization based in Lithuania that promotes human rights in Belarus and beyond through strategic public interest cases.

Works with UN bodies and other international mechanisms, giving priority to topics that have not yet been the object of their attention.
