"We continue the change-Democratic Bulgaria" (PP-DB) submitted to the parliament a draft decision on the adoption of the Rules for the Nomination Commission's activities and the conduct of a procedure for nominations, examination of applications and selection of members of the Anti-Corruption Commission, according to a reference on the website of the National Assembly.

Earlier, at a briefing in the National Assembly, the co-chairman of "Democratic Bulgaria" Hristo Ivanov announced that the rules for electing members of the anti-corruption body will be submitted to the parliament today.

It is envisaged that the Nomination Commission will consist of five independent members - one each from the composition and proposed by the Supreme Court of Cassation, the High Bar Council, the Ministry of Justice, the Ombudsman of the Republic of Bulgaria and the Audit Chamber.

Each of its members must meet the requirements of the Law on Combating Corruption - be a Bulgarian citizen with legal capacity who has no other citizenship;

not have been convicted of a crime, regardless of rehabilitation, and not exempt from criminal responsibility for an intentional crime;

not be deprived of the right to hold a certain public office or to exercise a certain profession or activity;

not to have overdue public obligations above the minimum wage;

not have been a member of a governing or controlling body of a political party in the last five years.

Among the requirements is also that in the last 5 years he has not been a member of parliament or a member of the European Parliament elected by the Republic of Bulgaria, nor a member of the Council of Ministers and that he has not held a position in the political cabinet of an executive authority. 

The Commission for the Prevention and Counteraction of Corruption of the National Assembly sends an invitation to the five institutions to appoint a representative as a member of the Nomination Commission within 15 days of receiving the invitation, the project foresees.

Within 7 days of the submission of the proposals, the Commission for the Prevention and Counteraction of Corruption verifies whether the proposed candidates meet the legal requirements and by decision determines and announces on the website of the National Assembly the composition of the Nomination Commission, convening the same for the first meeting in time no later than 7 days from the date of the decision.

The nomination committee sits in the parliament building and is administratively supported by the staff of the Commission for the Prevention and Counteraction of Corruption, it is written in the project.

At its first meeting, it elects a chairman and a deputy chairman.

The members of the Nomination Commission participate in its work personally, including remotely through a video conference connection, without delegating their powers to other persons, including

to other committee members.

At its first meeting, the Nomination Commission prepares a program and schedule for its work, which include familiarization with the submitted documents of the candidates for members of the Anti-Corruption Commission;

verification of the professional and moral qualities of each of them;

the collection of additional information about applicants, if necessary;

requiring additional documents from the applicants, the project also provides.

PP-DB invites GERB to submit together the rules for the anti-corruption commission, Petkov is satisfied that they are "moving in the right direction"

The committee selects the candidates based on their eligibility, admitting to the hearing those of them who meet the legal requirements for holding the position.

Within 30 days of the admissibility meeting, the Nomination Committee holds a public hearing of the admitted candidates and submits a detailed and motivated report to the National Assembly's Commission for the Prevention and Counteraction of Corruption, which contains an opinion on the presentation of the candidates, as well as a recommended evaluation based on conclusion on the fulfillment of the legal requirements for occupying the position;

the moral and professional qualities of the candidates and their qualifications and experience, etc.

PP-DB suggests motivated proposals for candidates for members of the anti-corruption body to be made by people's representatives or by legal entities with a non-profit purpose for the public benefit.

The National Assembly elects members of the Anti-Corruption Commission with a two-thirds majority of all representatives.

When three of the candidates do not receive the required two-thirds of the votes, a second vote is held in the same order.

If even then three of the candidates do not receive the necessary votes, the National Assembly adopts a decision to open a new election procedure.

Within three months before the expiry of the mandate of the Anti-Corruption Commission, the Anti-Corruption Commission issues a public invitation to submit proposals for candidates for the next members of the anti-corruption body, it is also written in the draft.
