Mumbai:

A Mumbai court has granted temporary bail to a 62-year-old man, arrested in a recent cheating case, on "medical and humanitarian grounds", two days after his death. Suresh Pawar died hours after the hearing on his bail plea was completed on May 9, while Additional Sessions Judge Vishal S Gaike granted him temporary bail two days later. Pawar was arrested for allegedly selling a property to a real estate agent on the basis of forged documents.

Pawar was in jail since December 31, 2021 and had sought temporary bail for six months on medical grounds. In his application, Pawar had said he was a serious diabetic and was also suffering from various age-related ailments.

He suffered a toe injury in February and was admitted to the state-run J J Hospital, from where he was later discharged. The petition said he developed gangrene in his toe and had to be amputated.

According to the petition, the high court had in March directed the jail authorities to provide proper medical treatment to Pawar and on April 19, he withdrew his bail plea from the high court.

On the same day, Pawar's health deteriorated and he had to be admitted to the J J Hospital again, the petition said. However, due to lack of proper medical treatment, his wound became septic and the leg below his knee had to be amputated.

According to the plea, the accused developed a lung infection and sought temporary bail for six months for medical benefits.

The court, in its order, said that considering Pawar's age, serious medical complications and further requirement of medical care, his plea for temporary bail can be considered purely on humanitarian grounds.
