A grand jury in New York has approved criminal charges against Donald Trump, who will now

be the first former US president to be indicted on criminal charges

.

An arrest warrant is expected to be issued while prosecutors are already negotiating with the former president's lawyers about the "choreography" of how he will surrender to the Manhattan district attorney's office to be presented.

While the details of the indictment are not yet known, they are expected to include the allegedly wrongful payment – being falsely reported as business and possibly campaign expenses – of $130,000 to buy the silence of Stormy Daniels, a porn star. , shortly before the 2016 presidential election.

The payment was to suppress Daniels's claim that she had a brief sexual affair with Trump in 2006.

The tycoon had invited his supporters to protest what he said was his impending arrest two weeks ago, and has since warned that he is the victim of "persecution" by a Soros-funded district attorney, promoted by "the radical left." doing the work of “anarchists and the Devil”, and that it would trigger “death and destruction” – which was interpreted as a threat of political violence from its ranks.

Yesterday he reacted on his social network declaring that these events "are nuclear" and urged people to "kneel down and pray."

In a statement shortly thereafter, Trump, piecing together phrases he has endlessly repeated in the face of all the investigations and indictments, declared that “this is political persecution and election interference at the highest level ever,” and charged that the “radical Democratic left – the enemy of the working men and women of the country – has promoted a witch hunt to destroy the Make America Great Again movement.”

The street in front of the offices of the district attorney in Manhattan, at the corner of the criminal courts, has been occupied by dozens of journalists, a large police presence and pro and anti-Trump protesters, before the imminent announcement of charges.

However,

it is precisely this spectacle that Trump has sought to use for the benefit of his campaign

– both to mobilize support from his base and to raise funds – as well as for his attack on his opponents and nurture the promoters of political conspiracies.

Trump is adept at responding to critics, researchers and political opponents - including prosecutors and judges - by counterattacking them as "radical leftists" who "hate" America.

The Republican has continued to insist that the participants in the coup attempt, which he instigated after the presidential election he lost, are "patriots" and that he is "the voice" of a movement to rescue and restore the country, and for this reason he is persecuted in the "biggest political witch hunt in history."

His son, Don Jr, nurtured this narrative, adding some

cold war

sauce : yesterday he began his

podcast

by declaring that the indictment against his father is “communist level bullshit.

This is something that would make Mao, Stalin and Pol Pot blush."

Trump – who has been the subject of two

impeachment

proceedings (removal) and who is under multiple criminal investigations – remains by far the most important Republican politician and enjoys a wide advantage in the polls among possible Republican contenders for the presidency.

bad fame is good

Therefore, not a few observers and analysts point out that

the current accusation, like the others, are potentially positive for his political future.

It is worth noting that the case in New York, even if he is eventually convicted of the crimes, technically would not have legal consequences for his candidacy, since the Constitution does not prohibit

or disqualify those with a criminal record from running for president.

According to the protocols, a defendant must be arrested and in this case the prosecutors will negotiate with the president's lawyers to determine how to proceed.

It is mandatory that the defendant be processed by the authorities, which includes fingerprinting and the famous photos that are taken from the front and profile of an arrestee.

The next step is to appear before a judge in an act in which the charges are read, they ask if the defendant pleads guilty or not guilty, they establish the conditions for the detainee while he awaits his trial and a calendar for the process.

Although in cases like this, where it is assumed (unless Trump wishes to offer dramatic images) that the defendant will voluntarily "turn himself in" to the authorities and not wait to be arrested.

It is not yet known if he will be handcuffed.

The tycoon could decide not to turn himself in voluntarily and remain in Florida, challenging the New York authorities, who would have to request his extradition (it is not a federal case, but a state one).

And yesterday the Republican governor – and a possible rival candidate for the defendant – declared that

“Florida will not attend an extradition request”, considering that the case is politically motivated.

Once arrested and prosecuted, the wait for a trial can extend from months to more than a year.

Meanwhile, while this case is much more salacious, the other judicial investigations proceeding against Trump are more serious.

In Georgia, a district attorney is about to decide whether to file formal criminal charges stemming from her investigation into

election interference, including alleged attempts by Trump to steal electoral votes in that state in the 2020 election.

In Washington, two federal investigations headed by prosecutor Jack Smith, appointed by the Department of Justice, are proceeding.

One is for the role of the then president around the assault on the Capitol on January 6, 2021;

the second is about the handling of the former head of state's secret official documents at his private mansion in Mar-a-Lago, Florida.

For now, all indications are that the presidential race will include a candidate who has questioned the loyalty and patriotism of all who dare criticize or oppose him—including journalists—who will seek a return to the White House while potentially facing multiple criminal charges in around porn actresses, the handling of state secrets, attempts to derail the electoral process and even a coup.
