[Reporter Bao Jianxin/Kaohsiung Report] The man surnamed Zhuang is suspected of acting as a judicial scalper, demanding 3 million yuan for "activity fees" from the woman surnamed Zhu in a civil lawsuit, falsely claiming that he can "settle black and white." The Kaohsiung Branch of the High Court believes that he has a criminal record of fraud , He also denied the crime, showed no remorse, and was sentenced to 3 years in prison.

People in the legal field said that if the defendant was found guilty of the crime in the second trial, if the facts of the case and the reasons for the judgment are the same as those in the original trial, the sentence will be maintained at most, and it is rare for the sentence to be changed from a heavier one.

The verdict pointed out that the defendant Zhuang Nan and the woman surnamed Zhu knew each other because of business, and in January 2020, they chatted with Zhu Nv and her brother, and learned that she had another civil case being tried by the Penghu District Court. Winning the pipeline dredging requires an activity fee of 1.8 million yuan, and a check with a denomination of 600,000 yuan must be issued in advance, and it can be cashed only after the victory is determined.

After Zhuang Nan obtained the three checks, he used one of the checks to repay the debt, and the creditor took it to cash it, which aroused Zhuang Nv's doubts. After Zhuang returned the money, he lied that the other two checks had been handed over. The chief in charge of clearing up, but because the other party refused to accept the check issued in her own name, Zhu Nu changed the company as the drawer and issued 3 more checks totaling 600,000 yuan.

Later, when Zhuang learned that Ms. Zhu had won the lawsuit, he told her through Ms. Zhu’s brother that in addition to paying the agreed fee of 1.8 million yuan, she would need to pay another 1.2 million yuan, of which 600,000 yuan would be used to unblock gangsters and the remaining 600,000 yuan. It was her personal remuneration, but because Zhu Nu found out that she had been cheated, she refused and reported to Kaohsiung City. The whole case was investigated and prosecuted by the Qiaotou District Prosecutor's Office.

Zhuang Nan argued that Zhuang Nv asked him to use the "five elements" to make the lawsuit go smoothly, and Fang agreed on a reward of 1.8 million yuan. He denied that he could dredge the judge, and insisted that the check was a loan.

Zhuang was sentenced to 2 years and 4 months in prison by the Qiaotou District Court for the crime of obtaining money by fraud. He appealed to change his innocence, but the prosecution thought it was too light to appeal. The statement was denied, and the victim was not compensated, the criminal method was bad, the law was seriously violated, and the reputation of the judiciary was seriously damaged. Therefore, the sentence was aggravated and no appeal was allowed.
