A conscript from Volyn was sentenced to three years in prison for

evading

the draft during mobilization.

"Glavkom" informs about this with reference to the verdict of the Kovel city and district court of the Volyn region from March 15.

The case file reports that in mid-October, the man was deemed fit for military service by the military medical commission.

However, the man ignored the dispatch to his unit.

In his defense, the accused claimed that he had a wife, two children and a sick mother to support him.

He stated that this was the reason why he did not want to join the army.

He confessed to what he had done and asked not to be severely punished.

The court considered the arguments of the accused and came to the conclusion that they do not correspond to reality.

In particular, the man said that one of the circumstances that prompted him to evade service was the need to support his family.

He explained that he unofficially works as a salesman and receives a salary of 15-20 thousand hryvnias.

The accused knew that the military allowance during martial law was 30,000 hryvnias.

Despite this, he stated that he still does not want to be mobilized because of a "bad feeling".

"From the above, the court came to the conclusion that the purpose of the defendant's evasion of military service during mobilization is not material support for the family, but fear of the burden of military service," the verdict said.

In addition, the court found out that the child, who is dependent on the accused, has another father and he regularly pays alimony.

It also became known that the accused's mother does not depend on him.

She lives alone and has no findings of disability or need for care.

Summarizing, the court emphasized that the release of the accused from serving the sentence with the application of Article 75 of the Criminal Code is desirable - will not prevent the commission of new criminal offenses.

And that's why he imposed a real term of punishment.

It will be recalled that earlier it was reported that the State Border Service warned that male evaders 

would be returned home from abroad

strengthening the conditions for the departure

 of men of conscription age abroad.
