Restrictions are directly related to martial law

According to the lawyer, all restrictions related to border crossing by men aged 18 to 60 are related to Cabinet of Ministers Resolution No. 57

of January 27, 1995

.

They contain a link to the introduction of a state of emergency or martial law on the territory of Ukraine.

That is, such restrictions can apply only in case of application of these legal regimes.

Yurchak noted that it is currently difficult to predict what will happen in the future in the legal field.

However, if martial law is lifted, the relevant restrictions will only exist if a state of emergency is imposed.

If none of the mentioned regimes will operate on the territory of Ukraine, then according to the current legislation, the restrictions will not be applied.

Which of the men can go abroad during the war

According to Government Resolution No. 57 (dated January 27, 1995), the following are defined:

  • rules and procedure for crossing the state border during war;

  • categories of citizens who can cross the state border during war.

The lawyer emphasizes that changes and additions are constantly being made to this resolution.

Currently, under the conditions of martial law, the following can go abroad:

  • young men under 18 and men over 60;

  • men whose close relatives died or went missing during the anti-terrorist operation/military operation;

  • citizens of Ukraine who permanently reside in the territory of another state, if they are permanently registered in the consular register and have the appropriate marks in the passport document;

  • persons who, by the decision of the military medical commission, were removed from military registration due to unfitness for military service.

We would like to remind that it is forbidden for persons with limited fitness for military service to cross the border during martial law.
