Rahul Gandhi

was on Friday disqualified from the membership of the Lok Sabha, the lower house of the Parliament.

Rahul Gandhi was sentenced to two years imprisonment by a court in Surat on Thursday after holding him guilty in a criminal defamation case in the year 2019.

Announcing Rahul Gandhi's disqualification, the Lok Sabha Secretariat said in a notification that Rahul Gandhi's disqualification as a Lok Sabha member would be effective only from March 23, when he was convicted.

The notification said,

"Consequent to the conviction by the Court of the Chief Judicial Magistrate, Surat... in terms of the provisions of Article 102(10(e)) of the Constitution of India read with Section 8 of the Representation of the People Act, 1951 for Kerala Shri Rahul Gandhi, Member of Lok Sabha representing Wayanad Parliamentary Constituency of K stands disqualified from the membership of Lok Sabha with effect from the date of his conviction, i.e. 23rd March, 2023..."

As per Section 8(3) of the Representation of the People Act, 1951, the moment a Member of Parliament is convicted of any offense and sentenced to imprisonment for a minimum of two years, he is disqualified to be a Member of Parliament It happens.
