Being a member of an unlawful association is an offense under the UAPA.

The court upheld the provision of UAPA.

A bench of Justice MR Shah, Justice CT Ravikumar and Justice Sanjay Karol gave this verdict.

The Supreme Court reversed its earlier decision.

The earlier judgment said that mere being a member of an unlawful association is not an offense under UAPA.

For this it is necessary to do some work.

The Supreme Court had to decide whether membership of an 'unlawful association' alone was sufficient to constitute an offense under the UAPA or membership must have some overt act which is a condition for attracting the penal provisions of the UAPA. .
