Congress MP Rahul Gandhi has been sentenced to two years imprisonment by a Surat court in Gujarat on Thursday, convicting him of defamation.

Rahul Gandhi has been sentenced in a defamation case for his comment on PM Narendra Modi's surname 'Modi'.

However, he has also been granted bail by the court.

Rahul Gandhi's membership of the Parliament hangs in the balance with the decision of the court.

At present, he has got time for 30 days to appeal in the High Court, during which he will not lose his membership of Parliament.

In the history of the Indian Parliament, many MPs have lost their membership of Parliament for different reasons.

According to the law, under Section 8 (3) of the 'Representation of the People's Act 1951', if an MP or MLA is convicted of an offense and sentenced to a term of two years or more, then his Parliament Or the membership of the Legislative Assembly ends.

Apart from this, he cannot contest any election till six years after his release.

On July 10, 2013, the Supreme Court gave a major decision in the Lily Thomas Versus Union of India case.

The Supreme Court had said in its decision that if an MP, MLA or member of the Legislative Council is found guilty of any crime and is sentenced to at least two years, he should immediately resign from Parliament, Legislative Assembly or Legislative Council. shall be disqualified for membership.

That means his election will be canceled and he will not remain a public representative.

Since this decision of the Supreme Court, till now many leaders have lost their posts. 

RJD MP Lalu Yadav was the first member 


After the Supreme Court's order was implemented, it first fell on Lalu Yadav.

In the year 2013, the court sentenced Lalu Yadav in the fodder scam case.

After this his parliament membership was over.

Along with this, he was also banned from contesting elections.

Since then till now Lalu Yadav is ineligible to contest elections.

JDU MP Jagdish Sharma had to lose his post


Janata Dal United (JDU) MP Jagdish Sharma from Bihar's Jehanabad was sentenced by a special CBI court in the fodder scam case related to illegal withdrawal from Godda treasury.

The court sentenced Jagdish Sharma to four years imprisonment and a fine of two lakh rupees.

Due to this, his parliament membership was lost.  

Lakshadweep's Lok Sabha member PP Mohammad Faizal's case in court


Lakshadweep MP PP Mohammad Faizal has been sentenced to 10 years imprisonment by the court.

After this his membership was gone.

The Election Commission had also announced the by-election for the Lakshadweep Lok Sabha seat.

But meanwhile the Kerala High Court stayed the sentence of PP Mohammad Faizal.

Presently this case is going on in the Supreme Court.

Faizal is accused of murderous attack on Congress leader and former minister PM Saeed and Mohammad Saliya.

Congress Rajya Sabha MP Kazi Rasheed lost his membership after being convicted in the MBBS seat scam case of admission in the medical college.

The Congress had sent Rasheed to the Rajya Sabha from Uttar Pradesh.

He was found guilty in the MBBS seat scam and was sentenced to four years in prison in 2013 by the court.

Mitrasen Yadav's MP post was lost after being convicted in a fraud case


Samajwadi Party MP from Faizabad Lok Sabha seat in Uttar Pradesh Mitrasen Yadav had to lose his membership of Parliament in the year 2009 under the 'Representation of the People's Act 1951'.

He had to lose his post after being convicted in a fraud case.

Mitrasen Yadav was sentenced to seven years by the court after being found guilty in the fraud case.

After this he was disqualified from Parliament membership.

Among these, the latest discussed case is of Azam Khan.

Azam Khan, an influential leader of the Samajwadi Party and MLA from Rampur in Uttar Pradesh, has lost his membership.

Azam Khan has been sentenced to three years in jail for making derogatory remarks on PM Narendra Modi.

On this he was stripped of his assembly membership. 

Earlier, Jharkhand's All Jharkhand Students' Union MLA Kamal Kishore Bhagat, Maharashtra's BJP MLA Suresh Halvankar, Maharashtra's own MLA Pappu Kalani and Madhya Pradesh's BJP MLA Asha Rani have lost their assembly membership after being convicted in different cases. .

Gujarat's Surat court has given immediate bail to Rahul Gandhi in the defamation case.

He has been given 30 days to appeal.

Till then his sentence has been suspended.

The court's sentencing decision puts his membership of Parliament in jeopardy under the law.

However, there have been indications from the Congress to take the matter to the High Court.
