Congress leader Rahul Gandhi has been sentenced to two years in a defamation case.

Congress leader Rahul Gandhi, who has been convicted in a defamation case for his remarks against Prime Minister Narendra Modi, has raised a big question on his future in the Lok Sabha.

On the other hand, BJP has got new energy to target Congress due to the court's decision.

The BJP has been running a campaign against him for more than two months.

An interesting example is the action taken by the Union Law Ministry in the case of a Lakshadweep MP after the conviction of Rahul Gandhi.

The Law Ministry has recommended the reinstatement of PP Mohammed Faizal after he was convicted by the Kerala High Court in an attempt to murder case.

MP PP Mohammad Faizal was convicted by a court in Lakshadweep in January.

But a week later, the Kerala High Court suspended the conviction and said that his disqualification as a Lok Sabha member would no longer be valid.

Meanwhile, the Election Commission announced the by-election in the Lok Sabha constituency of Sharad Pawar's Nationalist Congress Party MP Faizal.

The MP challenged this decision in the Supreme Court, after which the court asked to cancel the order of the commission.

As far as Rahul Gandhi is concerned, Congress sources believe he may face immediate disqualification if he does not challenge the verdict.

He said, Rahul Gandhi will do exactly that and will not be present in Parliament for some time.

As per Section 8(3) of the Representation of the People Act, 1951, a Member of Parliament becomes disqualified as soon as he is convicted of an offense and sentenced to imprisonment for at least two years.

According to experts, based on the order of the Surat court, the Lok Sabha Secretariat can disqualify Rahul Gandhi and declare his Wayanad seat vacant.

However, Lok Sabha officials who oversee disqualification procedures told NDTV on condition of anonymity that "there is no such rule book."

One of them insisted, "Show me your face and I'll show you the rule book."

In the matter of Rahul Gandhi's conviction, he said that the general practice is to wait till the 30-day period is over to make the call.

Rahul Gandhi was today found guilty and sentenced to two years in prison in a four-year-old criminal defamation case over his remarks about Prime Minister Narendra Modi's surname.

Rahul Gandhi had categorically said, "How can all thieves have only one surname Modi?"

After this, BJP MLA and former Gujarat minister Purnesh Modi had filed a case in Gujarat.

Rahul Gandhi has been granted bail and his sentence has been suspended for 30 days to allow time for an appeal.
