Conscripts and conscripts are on the military register according to their territorial affiliation, explains lawyer Iryna Leonova.

"You should not hand over a summons from a TCC to which you are not assigned. Handing over a summons outside of your place of residence is illegal, as military conscripts are registered at their place of registration." 

How to act if a summons is served in a "foreign" place

When serving a summons, it should be taken into account that representatives of the TCC do not have the right to send any actions to procurement centers in another region.

At the same time, employees of the military commissariats can refer to the TCC and SP for clarification of military registration data according to the place of registration. 

  • The lawyer advises to explain why you are in one or another place, to inform that you are registered in another settlement.

  • If the summons is served anyway, you can insist on drawing up an act of refusal to receive it.

In what cases it is possible to refuse a subpoena

 Iryna Leonova reminded in which cases conscripts can legally refuse to receive a summons:

  • If the name of a person is incorrectly indicated on the form, this is a reason to believe that this summons is addressed to another person.

  • If the summons is served by a person not authorized to do so.

  • In the event that the document does not have the seal of the TCCSP/signature of the military commissar.

  • If an old-style summons form is served.

When refusing a subpoena, the reasons must be given so that the authorized persons have to draw up an act of refusal.
