The Supreme Court has given a historic decision.

Now PM, Leader of Opposition in Lok Sabha and CJI together will select Chief Election Commissioner and Election Commissioners.

Justice KM Joseph said that in order to maintain democracy, the purity of the election process should be maintained otherwise it would have disastrous consequences.

A committee will appoint the Chief Election Commissioner and the Election Commissioner.

The committee will have the PM, the Leader of the Opposition in the Lok Sabha and the CJI.

The Supreme Court has given this historic decision regarding the formation of an independent panel like collegium for the appointment of Chief Election Commissioner and Election Commissioners in the country.

The constitution bench of five judges has given this decision.

The bench comprises Justices KM Joseph, Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and CT Ravikumar.

In fact, petitions were filed in the Supreme Court regarding the appointment of the Chief Election Commissioner and Election Commissioners in a fair and transparent manner.

Justice Rastogi said that I agree with the decision of Justice KM Joseph.

The present process of appointment of Chief Election Commissioners and Election Commissioners will be cancelled.

There will be a committee for appointment.

The Supreme Court said that there is a need to separate the functioning of the Election Commission from executive interference.

Also that the Election Commissioners should be given the same security as the CEC.

They cannot even be removed by the government.

The framers of the Constitution had left it to the Parliament to legislate for the appointment of the Chief Election Commissioner and the Election Commission, but the political dispensation betrayed their trust and has not legislated for the last seven decades.

The Supreme Court said that the Election Commission should be independent.

It cannot claim to be independent so would be unfair.

A person cannot have an independent frame of mind in a situation of obligation to the state.

A free man will not be a slave to those in power.

An honest person usually boldly confronts the big and powerful.

A common man looks up to him to protect democracy.

Lincoln declared democracy to be of the people, by the people and for the people.

The government should run according to the law.

Democracy can be successful only when all the stakeholders work on it to maintain the purity of the election process.

The rule of law is the basic foundation of a democratic form of governance.

The Supreme Court said that it is a promise to avoid the defects of nepotism, autocracy etc.

An Election Commission that does not guarantee the rule of law is against democracy.

In a wide spectrum of powers, if it is used illegally or unconstitutionally, it has an impact on the results of political parties.

We have the option of NOTA, which shows the voters' dissatisfaction with the candidates.

The right of a citizen to seek and receive information on candidates has been recognized as a fundamental right.

The qualities of competence must be complemented by independence.
