During the period of martial law and mobilization in Ukraine, officials may travel abroad only for official purposes, but there are several exceptions to this rule.

Specialists of the NGO "Juridychna Sotnia" provided an explanation regarding the departure of officials abroad.

They recalled that on January 27, the government adopted Resolution No. 69, which expanded the current rules for crossing the border with new points and established the procedure for leaving the country for officials and deputies. 

So, during martial law, the 

following must travel abroad exclusively for official reasons:

  • people's deputies and other officials, 

  • prosecutors, 

  • judges, 

  • heads of structural subdivisions of state bodies and local self-government bodies and employees booked for the period of mobilization for state or local government bodies by other state bodies. 

The complete list of persons subject to the ban on traveling abroad is quite large and is specified in clauses 2-14 of the rules adopted by the government.

However, there are

exceptions in which officials may travel abroad outside of business necessity:

  • are women and/or men who

    are single parents of a child

    under the age of 18 (inclusive).

    They can go abroad to visit or take their own children.

  • For treatment abroad

    .

    In this case, it is necessary to have documents that give the right to leave and enter Ukraine, as well as a letter from the head of the Ministry of Health about the list of persons who are ready to receive treatment agreed with a foreign party.

    Departure is allowed accompanied by one of the family members of the first degree of consanguinity.

  • In addition, the head of the DPSU may make a decision on permission to cross the border for persons specified in clauses 2-14 of these rules,

    in the event of the death abroad of one of the family members of the

    first or second degree of consanguinity.

  • The lawyers reminded that the issue of the departure of military personnel abroad was also regulated by the government resolution of January 27. 

    Thus, the rules for crossing the state border by citizens of Ukraine are supplemented by a new paragraph 2-15, which states that, subject to the introduction of martial law in Ukraine,

    servicemen are allowed to cross the border on the basis 

    of decisions adopted by the Minister of Defense, the head of another military formation formed in accordance with the law, the head of a special law enforcement agency , the head of the intelligence body for decisions on the implementation of tasks in the field of security and defense.

    It will be recalled that earlier the government explained the conditions under which female civil servants can go abroad.
