A 20-year-old engineering student, who approached the Supreme Court seeking permission to terminate her nearly 30-week pregnancy, on Thursday agreed to give birth and give the child for adoption at AIIMS.

A bench headed by Chief Justice DY Chandrachud took note of the All India Institute of Medical Sciences (AIIMS) report and said that it is not safe to abort at this stage now and that the woman is willing to give birth to a child.

Earlier, AIIMS was instructed to explore the possibility of safe abortion.

Keeping in view the sensitivity of the matter, a bench comprising Justice Chandrachud, Justice PS Narasimha and Justice JB Pardiwala asked Solicitor General Tushar Mehta, Additional Solicitor General Aishwarya Bhati and the woman's counsel to discuss the issue of the unborn fetus and its prospective parents after birth. Called to the Chief Justice's chamber for discussion to decide, as the unmarried woman said she would not be able to take care of the child.

Invoking extraordinary powers under Article 142 of the Constitution, the bench said, "The delivery of the child will be done by AIIMS at AIIMS as requested by the court."

The bench said, "We request the AIIMS director to ensure that necessary facilities are arranged without any charge so that the delivery takes place in a safe condition."
