Among them, Tainan Prison reported Zhang Ximing’s 16th parole case in October of the previous year. After the Ministry of Justice reviewed and decided that he would not be granted parole, he refused to accept the retrial, which was rejected by the Corrections Department. He decided to file an administrative lawsuit with the Tainan District Court to overturn the case and On October 5 last year, he appeared in court to state his opinions.

The plaintiff, Zhang Ximing, pointed out that although he was treated differently in the prison, he really worked hard to change his past, was motivated, and was even praised many times, but he was ignored. The defendant, the Correctional Office of the Ministry of Justice, stated that Zhang was more guilty than Zhan. One person was killed in homicide, 12 victims were kidnapped for ransom, and 3 victims were victims of attempted murder. So far, no reconciliation has been made with the victims.

The reason for the judge's ruling against Zhang Ximing is that although Zhang is at the first level, according to Article 77, Item 1 of the Criminal Law, Zhang Ximing "has" to be released on parole, not "should" be released on parole. Exercising scope of discretionary power.

Based on the principle of separation of powers, if there is no violation of the law, it should be legal, and the administrative court should not directly replace the correctional department to make a decision.

Zhang Ximing refused to accept the judgment and appealed to the Kaohsiung High Administrative Court. The judges of the collegial panel believed that the original judgment was not inappropriate, and still ruled that Zhang lost the case and could not appeal.
