The prosecution believes that the male college student pushed the victim out with full knowledge that it would cause death, but the judge pointed out that there is not enough evidence in the whole case to show that the defendant intentionally killed, and he also sent his mobile phone, identity card, etc. The evidence, the victim's mobile phone and wallet were left in place, indicating that the accused made no attempt to conceal the crime.

Therefore, the judge sentenced the male student to 20 years in prison according to the "quasi-rape to death crime".

In Article 299 of the South Korean Criminal Code, "quasi-rape" means sexual intercourse or indecent acts with the victim when the victim is unconscious or unable to resist.

Although the court did not impose a sentence based on intentional homicide, the sentence in the first instance was far higher than the usual 11 to 14 years in prison for the crime of "rape to death" in South Korea.

The judge said that the male college student failed to fulfill his due responsibilities, that is, to rescue the victims who fell from the building, to report to the police or medical units, and so on.

In addition to the 20-year sentence, the court also sentenced the male student to receive 80 hours of sexual violence treatment courses and banned him from working in institutions related to children, youth or the disabled for 10 years after his release from prison.
