New Delhi:

The Supreme Court has refused to hear the petitions filed against the caste census in Bihar.

The court said that these petitions seem to be a matter of publicity interest.

Why did the petitioners not approach the Patna High Court in this matter?

The bench of Justice BR Gavai and Justice Vikram Nath said this while hearing the matter.

Justice Gavai remarked that if stayed, how would the government determine how to provide reservation? 

Three petitions have been filed against the conduct of caste census in Bihar.

The petitions have been filed in the Supreme Court by an organization named Ek Soch Ek Prayas, Hindu Sena and Bihar resident Akhilesh Kumar.

Hindu Sena has said in its petition that the Bihar government wants to break the integrity and unity of India by conducting caste census, in which the decision of the Bihar government to conduct caste census has been challenged in the Supreme Court.

Seven questions were raised in this petition before the Supreme Court.

  • Bihar government is taking action to conduct caste census, is it a violation of the basic structure of the constitution?

  • Does the Constitution of India give the State Government the right to conduct caste census? 

  • Is the notification issued by the Deputy Secretary to the Government of Bihar on June 6 against the Census Act 1948?

  • Whether notification of caste census in the absence of law, legally allows the state?

  • Has the decision of the state government to conduct caste census been taken by all the political parties with a unanimous decision?

  • Is the decision of political parties binding on the government for Bihar caste census?

  • Is the Bihar government's notification of June 6 against the Supreme Court's constitution bench's decision in the Abhiram Singh case?

  • There has been a demand to cancel the notification issued by the state government on June 6 for caste census in Bihar.

    There is also a demand in the petition to stop the Bihar government from conducting caste census.
