Delivery of summonses in public places

Since the Law "On Mobilization Preparation and Mobilization" does not specify where the summons should be served, summonses can be issued anywhere, including on the streets and near the subway.

As explained by the head of the personnel department of the headquarters of the command of the Ground Forces of the Armed Forces of Ukraine, Roman Horbach, public summonses are issued primarily due to the need to update data on men who do not come to the military commissariat for this purpose. 

What should be in the summons

According to Serhii Popko, the head of the Kyiv City Military Administration, "the subpoena must contain the signature of the head of the territorial recruitment and social support center and a wet seal.

The summons must state the date of delivery, the address of the Military Commissariat and the time at which it is necessary to go there."

 Summons can be served by:

  • local governments,

  • managers of enterprises, institutions, organizations, including educational institutions, regardless of the subordination and form of ownership of their employees and students,

  • owners of houses to persons who live there,

  • officials of the district (city) military commissariat directly.

Is it legal to fill out a subpoena on the spot?

Lawyer Viktoriya Tyutyunnikova believes that the subpoena can be filled out before delivery.

It will be legal.

But

if this is done in the presence of the head of the TCC, on whose behalf the summons is served, or if he does it personally.

 The conscript receives a summons, and the representative of the TCC has a "root" and a form with a signature on receipt of the summons.
