Following his previous office, secret documents were also found in his own study and garage in Delaware, forcing Attorney General Jaland (Merrick Garland) appointed special prosecutor Hull (Robert Hur) to investigate whether wrongdoing was involved.

Legal experts said that both Biden and former President Trump were revealed to have hidden secret documents, but the nature of the two cases is very different, and Trump may face greater legal risks.

Garland explained the timeline of the whole incident, referring to the Biden lawyer’s work at the Biden Center for Diplomacy and Global Engagement at the University of Pennsylvania in Washington, DC, where Biden briefly worked after stepping down as vice president in 2017 on November 2 last year. On December 20 last year, Biden's personal lawyers stated again that they found the second batch of confidential documents during Biden's tenure as vice president in his garage in Wilmington, Delaware.

On January 5 this year, Rausch suggested that Garland appoint a special prosecutor to investigate further.

On the 12th, Biden's lawyer notified the Department of Justice for the third time that another confidential document was found in the study of Biden's home, and Garland also officially announced the appointment of Robert Hur, the U.S. Attorney of Maryland under Trump, as special Prosecutor, investigate whether any person or entity violated the law in Biden's secret possession of secret documents.

"Reuters" pointed out that neither Biden nor Trump should keep any confidential documents in private. It is illegal to remove or retain confidential documents knowingly or voluntarily, but these two cases that must be investigated by special prosecutors are in very different in nature.

In the case of Trump, when NARA has never been able to fully retrieve Trump’s private collection of documents, the Ministry of Justice issued a search order to forcibly retrieve them, and finally found more than 300 confidential documents.

On the contrary, Biden actively searched, reported and handed over.

Experts said that only deliberately retaining or removing confidential documents constitutes a crime. Trump obviously faces more legal risks than Biden.

However, after Biden criticized Trump's "irresponsibility" for hiding secret documents, he was also found to have hidden documents, which made the situation more complicated if the Department of Justice had to prosecute Trump in the future.
