The hearing on the bail of Ashish Mishra has been postponed in the Supreme Court.

The Supreme Court will now hear the bail application of Union Minister Ajay Mishra's son Ashish Mishra in the Lakhimpur Kheri violence case on January 19.

The Supreme Court accepted the request of the victim's lawyer to postpone the hearing.

A bench of Justice Suryakant and Justice V Ramasubramaniam heard the petition.

Ashish Mishra has challenged the decision of cancellation of bail from the Allahabad High Court in the Supreme Court. 

The Supreme Court asked the UP government to tell whether the accused in the second FIR is still in jail?

Justice Suryakant said on the day-to-day hearing of Prashant Bhushan that there is something in our mind, a big issue is involved.

Any timeline determination would affect the prosecution's case.

Prashant Bhushan, on behalf of the victims, demanded to postpone the hearing for tomorrow, or for next week.

He said that the health of senior advocate Dushyant Dave is not good, so the hearing should be postponed.

The Supreme Court asked the UP government whether the accused have been arrested in the second FIR as well.

In the Lakhimpur Kheri case, the trial court told the Supreme Court that it would take at least five years to complete the trial of the case.

There are 200 witnesses, 27 are CFSL reports.

Prashant Bhushan said that some witnesses have been attacked.

Some have been threatened.

Continuous day-to-day hearing can be done.

The testimony of material witnesses can be that he is the son of MoS (Home), in which case the trial should be held on a day-to-day basis.

Witnesses have been brutally attacked.

He had said to teach a lesson by giving a statement.

Prashant Bhushan, the lawyer for the aggrieved party, accused the UP government of favoring the accused.

In the last hearing, the court had asked the lower court that how much time would it take to complete the trial in the Lakhimpur case.

In the hearing, Mukul Rohatgi, on behalf of Ashish Mishra, had said that the lower court has rejected the application for discharge of Ashish Mishra.

Charges have been framed against him, he was not in the car at the time of the incident, yet he is in jail for more than a year.

Earlier the High Court had granted bail, but the Supreme Court canceled the bail and again sent the case to the High Court.

During the hearing, the Supreme Court had said that first the charges in this case should be allowed to be framed in the lower court, after that the bail plea would be heard.

On 6 December 2022, the ADJ Court of Lakhimpur has framed charges against all the 14 accused including Ashish.

Violence took place on 3 October 2021 in Tikunia police station area of ​​Lakhimpur district of UP.

It is alleged that at the behest of Ashish Mishra alias Monu, son of Union Minister of State for Home Affairs, Ajay Mishra Teni, the protesting farmers were run over by a Thar jeep.

4 people had died in the incident.

After the violence broke out, 8 people lost their lives in this entire incident.
