The mobilization that began in Ukraine on February 24, 2022 is still ongoing, therefore, any man aged 18 to 60 can receive a summons. 

Due to the need to update data on men who do not visit the military commissariat to update data, summonses will continue to be issued in public places, said Roman Horbach, head of the personnel department of the headquarters of the Ground Forces of the Armed Forces of Ukraine.

Who and how can issue subpoenas

According to the Law of Ukraine "On Mobilization Training and Mobilization", territorial recruitment and social support centers and commanders of military units can carry out conscription.

TCC issues subpoenas with the participation of local self-government bodies and with the involvement of enterprises, institutions and organizations of all forms of ownership, individual entrepreneurs.

Notification of the appearance of citizens for registration is issued by order of the district (city) military commissar in accordance with the form in accordance with Appendix 4 to the law. 

The summons can be served:

  • Relevant bodies of local self-government.

  • Heads of enterprises, institutions, organizations, including educational institutions, regardless of the subordination and form of ownership of their employees and students.

  • Owners of houses to persons who live there.

  • Officials of the district (city) military commissariat directly.

According to Part 3 of Article 22 of the "Law on Mobilization Training and Mobilization", during mobilization, citizens are obliged to report to military units or assembly points of the territorial center of recruitment and social support within the time limits specified in the documents they received (mobilization orders, summons heads of territorial staffing and social support centers), or at the time specified by the commanders of military units (military conscripts, reservists of the Security Service of Ukraine — at the call of the heads of the bodies in which they are on military registration, military conscripts, reservists of the Foreign Intelligence Service of Ukraine — at the invitation of the heads of the relevant divisions of the Foreign Intelligence Service of Ukraine, military servicemenof the Operational and Rescue Service of Civil Protection - at the call of the heads of the relevant management bodies of the central executive body that implements state policy in the field of civil protection).

The summons must

be served to the conscript personally,

but nowhere is it specified where exactly it should be served and that it cannot be served at roadblocks, streets, or in public places. 

What should be indicated in the summons

The summons cannot be filled out by a conscript, authorized persons must hand over the already filled out form.

The summons must contain the following information:

  • surname, first name and patronymic of the conscript,

  • date of birth of the conscript,

  • address,

  • work place,

  • type of summons,

  • date, time and address of the place where the conscript must report,

  • clarifications regarding documents or things that should be taken with you,

  • the name of the body, seal, signature, surname, first name and patronymic of the head of the procurement center.

The conscript receives a summons, and the representatives of the TCC keep a "root" and a form with the conscript's signature on receipt of the summons.

Responsibility does not arise if the summons is not correctly issued and the person does not appear on it at the military commissariat.

Responsibility for evading mobilization

According to the resolution of the Supreme Court of Justice of Ukraine dated 14.12.2021, case No. 761/8429/16-k, responsibility for evasion of the draft arises when a person received a summons, signed for its receipt and did not appear, or when he refused to receive a summons in the presence of witnesses.

Evasion from mobilization involves administrative and criminal liability.

Administrative liability is provided for in Article 210 of the Code of Administrative Offenses - violation by conscripts, conscripts, and reservists of the rules of military accounting, the violation of which entails the imposition of a fine from UAH 510 to UAH 850.

Criminal liability is provided for in Article 335 of the Criminal Code of Ukraine - evasion of conscription for military service, military service by conscription of officers, the violation of which is punishable by restriction of freedom for a term of up to three years.
