If a Ukrainian

soldier

has gone missing in connection with hostilities for a period of more than 2 years, or at least 6 months under certain conditions, his family can apply to the court to declare him dead and subsequently apply for appropriate payments.

This was announced by the Verkhovna Rada of Ukraine Commissioner for Human Rights, Dmytro Lubinets.

He noted that in

accordance with Article 318 of the Civil Procedure Code , the following

must be provided in the application :

  • the reasons for the impossibility of obtaining and restoring documents certifying the fact of death or evidence confirming it;

  • evidence confirming the circumstances stated by the applicant (testimony of eyewitnesses, medical documents on death);

  • a certificate on the impossibility of restoring lost documents (written refusal by the state civil registration authorities).

"The court can declare dead a person who disappeared in connection with hostilities after 2 years. However,

when the circumstances of the disappearance are known

(he took part in a combat task and did not return),

then he can be declared dead no earlier than 6 months have passed

," Lubinets explained.

The ombudsman noted that

the court's decision to recognize a person as dead is the basis for obtaining a death certificate

from the RACS authorities.

Victims of Ukraine in the war

In the summer, the Ministry of Defense explained that Ukraine's losses in the war are a state secret, so the number of dead is not disclosed.

At the end of August, the Commander-in-Chief of the Armed Forces of Ukraine Zaluzhny announced that

 almost 9,000

 Ukrainian defenders had died in the war with the Russian invaders. 

At the end of November, Oleksiy Arestovych, adviser to the OP,

said

that Ukraine's losses in the war amounted to "from 10 to 20 thousand dead soldiers", besides there are tens of thousands of wounded.

Military expert Oleg Zhdanov said that Ukraine, like Russia, suffers losses in the war, especially in the battles that are currently taking place near Bakhmut.

Regarding the number of casualties, he referred to the data of the adviser to the head of the Office of the President, Mykhailo Podoliak, 

about 13,000 dead.

 "Yes, we will suffer losses, but I repeat, not as huge as the Russian Federation. Our losses are much smaller," the expert said.

He noted that taking into account the number of dead, 

the number of wounded Ukrainian soldiers may be 30,000-40,000.

At the same time, the spokesman of the President of Ukraine, Serhiy Nikiforov, previously stated that 

 only the Commander-in-Chief, the Minister of Defense, or the Supreme Commander-in-Chief should provide reliable

information about losses .
