Senior advocate and Rajya Sabha MP from the Samajwadi Party, Kapil Sibal has accused the central government of trying to take over the "last bastion of independence" judiciary.

He said that the courts will stand firmly against it.

On the ongoing tussle over the appointment of judges and the tension with the Centre, Kapil Sibal made it clear that the present collegium system has its drawbacks, but giving complete freedom to the government is not the right approach.

In an exclusive interview to NDTV, former law minister Kapil Sibal said that the government wants to take the "final decision" on the appointment of judges and it would be a "disaster" if that happens.

Asked about the comments of Vice President Jagdeep Dhankhar and Law Minister Kiren Rijiju, Sibal said they have not remained silent on any other issue, why would they remain silent on this?

"He said," Judiciary is the last bastion of independence, which they (government) have not yet captured.

They have occupied every other institution from the Election Commission to the post of Governors, Vice Chancellors of Universities to ED (Enforcement Directorate) and CBI (Central Bureau of Investigation).

The investigation department, the NIA and of course the media too have been captured." 

Sibal termed as "completely unfair" the Law Minister's remark that courts take "too many holidays".

Sibal sarcastically said, 'The Law Minister is not a practicing advocate.

A judge spends 10 to 12 hours per day hearing petitions, reading the background for the next day's hearing and writing the judgement.

His holidays are spent in handling the spillover. 

He claimed that the courts work harder than the parliamentarians.

Sibal said that in the last one year, from January to December, the Parliament worked for 57 days.

Whereas the court works for 260 days in a year."

Let us inform that earlier this month, Vice-President Jagdeep Dhankhar in his first address in the Rajya Sabha raised the issue of the repealed law on NJAC i.e. judicial appointments.

He accused the Supreme Court of compromising "parliamentary sovereignty" and ignoring the "mandate of the people".
