[Reporter Yang Guowen/Taipei Report] National Taiwan University selected Guan Zhongmin as the president four years ago, but one of the candidates for the president, Professor Wu Ruibei of National Taiwan University, believed that the selection process had major flaws, and sued the Ministry of Education to revoke the administrative sanction of the appointment. The Taipei High Administrative Court held that there was no competitive relationship between Wu Ruibei and the five candidates recommended by the school affairs meeting, and there was no need to protect rights, so Wu Ruibei lost the case.

Wu refused to accept the appeal, and the Supreme Administrative Court today ruled that Wu lost the case.

National Taiwan University formed a selection committee to select the president in 2018. However, during the selection period, Guan Zhongmin did not reveal that he was the independent director of Taiwan University, and Cai Mingxing, the vice chairman of Taiwan University, also served as a selection committee member, which caused a lot of controversy and led to the selection of the president of National Taiwan University. After a long delay, Guan Zhongmin was finally elected as the principal.

On December 24, 2018, the Ministry of Education announced the appointment of Guan Zhongmin as the president of National Taiwan University, with a term of four years from January 8, 2019 to January 7, 2023.

However, National Taiwan University professor Wu Ruibei, one of the 8 president candidates, believes that the Ministry of Education has the right to appoint national universities, and the university selection organization, procedures, and legality of candidates should be reviewed before deciding whether to agree to the appointment.

Wu Ruibei pointed out that since June 2017, Guan Zhongmin has served as Taiwan's independent director and the audit committee and salary committee, while Taiwan's deputy director and director Cai Mingxing is a member of the principal selection committee. The two have special important Cai Mingxing has the right to deliberate and decide whether Guan Zhongmin is qualified to be the principal, which will affect the fairness of the selection and cause unfair competition. He was dismissed because of his appeal, so he filed an administrative lawsuit, requesting the Ministry of Education to revoke the appointment of Guan Zhongmin Administrative punishment for the president of National Taiwan University.

Guan Zhongmin replied that during the selection process of the principal, there were no matters that should be disclosed in accordance with the law, and the selection committee met on January 5, 2018 and decided that the selection procedures should be handled in accordance with relevant laws and regulations, and his qualifications for election are legal.

The Taipei High Administrative Court held that Wu Ruibei had only obtained the qualification of "principal candidate selected by the selection committee in the first stage", but not the qualification of "principal candidate recommended by the school affairs meeting". The stage and the final stage become the qualifications for the selection committee to select candidates for the president of National Taiwan University. There is no competitive relationship between Wu and the five candidates for the president, including Guan Zhongmin, recommended by the school affairs meeting. Wu will not sue for this lawsuit As a result, he became a candidate for the principal. His petition to revoke the original punishment was not necessary for the protection of rights, and the judgment was rejected in October of the previous year.

Wu Ruibei refused to accept the judgment and filed an appeal.

The Supreme Administrative Court found that Beigaoxing’s usage of the confession was correct, and the judgment was dismissed today, and the whole case was settled.
