The Parliament rejected at first reading the bill of Vladislav Panev from "Democratic Bulgaria

"Democratic Bulgaria" is a center-right political association composed of "for changes in the Law on Territorial Planning (ZUT). It proposed to ease the regime for the construction of installations for the production of electricity and thermal energy or energy for cooling from RES to be used for own needs. It was also envisaged to relax the regime for the construction or reconstruction of building heating/cooling installations in condominium buildings. This will reduce the administrative burden and ensure greater energy independence of the owners, was the motive of the importer.

However, the MPs accepted at first reading two other bills for changes in the ZUT - by Manol Genov from "BSP for Bulgaria" and by Mladen Shishkov (GERB-SDS).

Nastimir Ananiev: After analysis, a new ZUT will be drawn up

The two draft laws have identical content and with them it is proposed to postpone the entry into force of amendments to certain articles relating to the development of undeveloped territories, the report of the committee on local self-government states.

It is about Art.

59 para. 1 of the ZUT, which says that outside the boundaries of the urbanized territories, construction is allowed subject to compliance with the provisions of an effective general development plan for the territory of the municipality or for part of it, and based on an effective development plan for a landed property or for a group of landed properties or a parcel plan for the elements of the technical infrastructure, after a change in the purpose of the land, when this is required under the order of a special law, except in the cases under Art.

109, para.

2 and 3.

With the latest amendment to the ZUT, the entry into force has been delayed until January 1, 2023, and the authors of the bills now envisage the delay to be until January 1, 2025. The main reasons are that the procedures for selecting a contractor under the Public Procurement Act in most cases are appealed and this requires additional time for the contractor selection decision to take effect or requires a new contractor selection procedure to be conducted.

It is difficult to obtain the source data and information necessary for the development of general development plans, related to the organization of the respective territory, the proponents of the changes also point out.
