On Monday, despite the recommendation of the Collegium, a hearing was held in the Supreme Court on the issue of delay in the appointment of judges.

The tussle between the government and the Supreme Court Collegium continues on the collegium issue.

Meanwhile, it has come to light that the government has returned 20 files related to the appointment of High Court judges from the Supreme Court Collegium.

Also said that the collegium should reconsider these.

These files also include the appointment file of advocate Saurabh Kirpal.

He recently spoke openly about his being gay. 

Sources related to the process of appointment of Supreme Court and High Court judges said that the government had sent back the files to the collegium on 25 November.

Not only this, strong objection was also expressed about the recommended names.

Out of these 20 files, 11 were new files and 9 were re-sent by the Supreme Court Collegium. 

Why was there an objection to Saurabh Kirpal's name?


In fact, the collegium headed by the then Chief Justice of the Supreme Court NV Ramana had recommended the appointment of lawyer Saurabh Kirpal as a judge in the Delhi High Court.

Saurabh Kirpal is the son of former Chief Justice of India BN Kirpal.

Kirpal's name was sent to the Supreme Court collegium by the Delhi High Court collegium in October 2017.

But, the Supreme Court collegium postponed the consideration of Kirpal's name three times.

Admitted to being gay in an interview,


lawyer Saurabh Kirpal recently told NDTV that he thinks this happened to him because he is gay.

SA Bobde's collegium, who was the Chief Justice before Justice NV Ramana, had allegedly sought more information about Kirpal while postponing his name.

However, later in November 2021, after NV Ramana became the CJI, his name was recommended to the Centre.

Hearing on the issue was held in the Supreme Court


Earlier on Monday, despite the recommendation of the collegium, a hearing was held in the Supreme Court on the issue of delay in the appointment of judges.

The Supreme Court observed that there has been a delay of months by the Center in considering the appointment of judges proposed by the collegium.

The Supreme Court remarked that it appears that the government is unhappy that the National Judicial Appointments Commission (NJAC) has not passed the constitutional muster.

Let us tell you that two days back Union Law Minister Kiren Rijiju had said that the collegium cannot say that the government should immediately approve every name sent by it.

Then they should appoint themselves.
