Tarun Tejpal gets a blow from the Supreme Court

New Delhi:

Journalist Tarun Tejpal, accused in the rape case, has received a setback from the Supreme Court.

The accused had filed a petition in the Supreme Court regarding the hearing of the case in camera i.e. in a closed room of the court.

The court has rejected the petition of Tarun Tejpal.

The Supreme Court said that the accused does not have the right to say that the hearing should be held in a closed room.

We are not inclined to interfere in the decision of the High Court in this matter.

The Supreme Court also left the decision to the High Court whether the hearing of the case should be physical or in a virtual court.

During the hearing, CJI DY Chandrachud said whether an accused can claim that the trial should be held in camera, while the victim does not make this demand.

The provision says that the investigation leading up to the trial will be held in camera.

We are past that stage.

Senior advocate Kapil Sibal, appearing for Tejpal, said that this is going to be a media trial where my reputation is at stake.

In such a situation, the hearing of this matter should be done in camera.

In fact, Tehelka's former editor Tarun Tejpal had reached the Supreme Court.

The Bombay High Court had demanded an in-camera hearing of the appeal of the case and said that the case should be heard 'in camera'.

Journalist Tarun Tejpal has filed a petition in the Bombay High Court seeking an 'in camera' hearing on the appeal filed by the Goa government against his acquittal in a 2013 rape case.

Which was rejected by the High Court on 24 November 2021.

Tejpal argued that in an appeal against the order of acquittal, it is necessary to preserve the identity of the accused like the victim.
