The Supreme Court is ready to examine the issue of recognizing same-sex marriages under the Special Marriage Act.

The Supreme Court issued a notice to the Central Government seeking its reply.

Along with this, a notice has also been sent to the Attorney General seeking a reply within four weeks.

Now the Supreme Court will decide whether same-sex marriage can be given legal recognition or not.

The Supreme Court said that such a petition is pending in the Delhi High Court.

On this, advocate NK Kaul said that the Central Government has told the Kerala High Court that it will apply to the Supreme Court to transfer all the cases.

A bench of CJI DY Chandrachud and Justice Hima Kohli heard the matter.

Two couples of homosexual youths have filed petitions in the Supreme Court demanding the inclusion of same-sex marriages in the Special Marriage Act.

Two gay men living in Hyderabad have filed a PIL seeking recognition of same-sex marriages under the Special Marriage Act.

Petitioners Supriyo Chakraborty and Abhay Dang have been with each other for almost 10 years.

Their relationship has also been supported by their parents, family and friends.

The petitioners say that the Special Marriage Act is contrary to the Constitution of India.

It discriminates between same sex couples and opposite sex couples.

It deprives same-sex couples of legal rights as well as the social recognition and status that flow from marriage. 

Another couple has filed a public interest litigation before the Supreme Court.

In this, there has been a demand for recognition of all members of the LGTBQ community.

Parth Firoz Mehrotra and Uday Raj Anand are in a relationship with each other for the last 17 years.

They claim that they are currently raising two children together, but since they cannot legally consummate their marriage.

This has resulted in a situation where both the petitioners cannot have a legal parent-child relationship with their two children.

In this case, Senior Advocate Mukul Rohatgi, on behalf of the petitioner, said that this application takes forward the decision of the court given in Navtej Johar and Puttaswamy case.

This is a live issue on the issue of succession, as people living on the basis of same-sex relationships are getting old.

He is also worried about handing over the legacy to his successor.

The bench asked what the Kerala High Court had said in this regard.

On this, advocate NK Kaul said that all the issues including joint account of the bank, child through surrogacy, gratuity have been asked to be kept in mind.
