The Ministry of Labor and Social Protection of the Population has approved the Regulation on the sale of apartments through auction.

APA reports that Prime Minister Ali Asadov signed a decision on this.

This Rule applies to multi-apartment buildings built in Ramana settlement of Sabunchu district of Baku city, Umid settlement of Garadagh district, Khojasen settlement of Binagadi district, Absheron, Lankaran and Samukh districts, as well as in Kurdakhani settlement of Sabunchu district of Baku city on the order of the State Committee for Refugees and IDPs of the Republic of Azerbaijan. Determines the procedure for the sale of apartments located in multi-apartment buildings under construction in the Absheron district through an auction held in the form of an open auction.

If it is not possible to sell the apartments online through the official website of the Ministry of Labor and Social Protection of the Population, they will be sold by auction.

In order to sell apartments at auction, the Ministry of Labor and Social Protection of the Population applies to the Organizer by submitting the information provided by the Regulation on apartments and concludes an agreement with him on the organization of the auction.

The organizer takes the following measures in connection with the preparation of the auction:

- provides information about the auction at least 30 days before the auction day in accordance with this Rule;

- accepts orders and documents attached to it from persons who want to participate in the auction electronically or on a paper carrier, registers them;

- creates a commission for conducting auctions and involves independent experts in its work;

- makes settlements with the participants of the auction.

The starting price of apartments is determined by an independent appraiser engaged by the Ministry in accordance with the law "On Appraisal Activities".

For the purpose of conducting the auction, the Organizer creates a Commission consisting of 5 members - representatives of the Ministry of Labor and Social Protection of the Population (2 people), the Ministry of Economy (2 people) and the Ministry of Finance (1 person) and its work regulations are approved.

The chairman of the commission is elected from among the members of the commission by voting in accordance with this Regulation.

Decisions of the Commission are adopted by a simple majority of the members of the commission participating in the meeting through open voting, with one vote for each member of the Commission.

The Commission is empowered when at least two-thirds of its members attend the meetings of the Commission.

In case of equal votes, the vote of the Commission chairman is considered decisive.

Commission members cannot abstain during voting.

The commission performs the following tasks:

- ensures the auction;

- Registers the auction participants based on the information (documents) provided by the organizer;

- if a controversial situation arises during the auction, he stops the auction and informs the Organizer about it;

- determines the winner of the auction;

- formalizes the final and other protocols of the auction and submits it to the Organizer for approval;

- Performs other tasks assigned to him by the organizer.

At least 30 days before the day of the auction, the organizer will publish the auction form, information about the auctioned apartment in accordance with this Rule, the starting price of the apartment, the start and end date of accepting orders, the address of the place of receipt of documents, in the media and on its official website, at least 30 days before the day of the auction. publishes a notice on the holding of the auction, which includes the list of documents required to participate in the auction, the date, time and address of the auction, the deposit amount calculated as 5 percent of the starting price of the apartment and the relevant bank account for its transfer, information on the determination of the winner of the auction.

In order to participate in the auction, a copy of the document confirming the payment of the fee, notarized copies of the legal entity's charter and registration certificate, and if the person submitting the order is a natural person, a copy of the document confirming his/her identity must be attached to the order to participate in the auction.

If the order is submitted by a representative of a legal entity or an individual, a document confirming the authority of the representative must also be submitted.

A natural or legal person who submits the documents mentioned in this Rule no later than 3 working days before the start of the auction gets the right to be a participant in the auction.

If the auction is not held, if a natural or legal person is not allowed to participate in the auction in the cases provided for in this Rule, or if the participant is not the winner of the auction, the bet must be returned.

Unless otherwise specified in the notification, the Organizer may refuse to hold the auction at any time, but no later than 3 working days before the day of its holding, by drawing up an appropriate protocol.

If the auction is refused in violation of the period specified in this Rule, the real damage caused to the participants shall be paid by the Organizer.

The order and the documents attached to it are accepted and registered by the Organizer, and in return, the persons allowed to participate in the auction are given a ticket with their auction participation number.

The person who ordered the auction is not allowed to participate in the auction in the following cases:

- if the person who placed the order is not recognized as a participant in accordance with relevant normative legal acts;

- if the authority of the representative of the person who placed the order is not approved in accordance with the legislation;

- if the documents indicated in the notification are not fully submitted or not correctly compiled;

- when the bet is transferred to the Organizer's account in an amount less than specified in the notification or later than the period specified in this Regulation.

The sale of the auctioned apartment starts after its starting price is announced.

The starting price of the auctioned apartment is increased by the participants.

Each new offer should not be less than 1 percent of the starting price.

By picking up their ticket, the participants agree to buy the apartment at the advertised price.

The new sale price of the auctioned apartment is repeated three times.

If none of the other participants raises their ticket and expresses their opinion about the offered price, the auction is considered to be over.

The participant who offered the highest price is considered the winner of the auction.

If none of the participants raises their ticket after the starting price has been announced three times, the auction is considered not completed.

If there is no order in the first two auctions for the sale of apartments (or if the apartment is not sold), in the third auction, the selling price of that apartment is 10 (ten) percent of the starting price, in the fourth auction it is 20 (twenty) percent of the starting price, in the fifth auction it is 30 (thirty) percent of the starting price. percentage is lowered.

The paid beh is included in the sale price of the sold apartment.

The bet paid by the unsuccessful participants of the auction is returned within 10 working days according to the lists provided by the Organizer.

The winner of the auction must pay the purchase price, taking into account the participation bid, no later than 10 working days after the end of the auction.

In the event that the auction does not take place in accordance with this Rule, the bet paid by the participants is not returned.

If the winner of the auction does not sign the protocol on its results on the day the auction ends or does not transfer the money to be paid to the specified account within 10 working days after the approval of the protocol by the Organizer, the results of the auction will be canceled and the paid bet will not be returned.

In the cases mentioned in this Regulation, the resale of apartments through auction is carried out by the Ministry of Labor and Social Protection of the Population according to this Regulation.

In connection with the organization of auctions, the Organizer is paid a service fee in the amount of 3 percent of the final sale price of the apartments.

Funds received from the sale of apartments are transferred to a special account opened for this purpose by the Ministry of Labor and Social Protection of the Population within 3 working days, minus the service fee determined by this Regulation.

The results of the auction are formalized with the protocol signed by the members of the Commission on the day of its completion.

The Organizer, who refuses to sign the final protocol, must return the quince to the winner of the auction in double amount, as well as compensate for the real damage caused as a result of participating in the auction.

The final protocol signed for the purpose of state registration of the rights of the auction winner on the real estate sold as a result of the auction is sent by the Organizer electronically to the state register of real estate within 5 working days after payment in accordance with this Rule, and the winner of the auction is informed about it through one of his feedback means. .

After obtaining the relevant information, the winner of the auction applies to the registration authority for the registration of the property right on the apartment.

On the basis of that application, the ownership right of the winner of the auction over the apartment is registered in the state register of real estate and an electronic extract from the state register is issued.

The organizer publishes (announces) information about the results of the auction in the media within 15 working days from the day of the auction and places it on its official website.
