The former director of the Emergency Management Agency, Fadil Kodra, through his lawyer Faton Fetahu, submitted on Friday to the Basic Prosecutor's Office in Pristina, a criminal complaint against the Minister of Internal Affairs, Xhelal Svecla.

In the criminal complaint that Kodra made through lawyer Fetahu, he accuses Minister Sveçla of violating the rights of the labor relationship and misuse of official position or authority.

Telegrafi has secured the criminal report that Kodra submitted to the Basic Prosecutor's Office of Pristina.

"The accused person, in his capacity as an official person, namely as the head of a government institution, deliberately and contrary to his legal authorizations and the legislation in force, has issued Decision no.

0529/2022, dated 14.07.2022, through which it repealed Decision no.

107/2015, dated 13.03.2015, even though in the circumstances of this particular case, the annulled decision has not been in force for years, since it was annulled ipso-jure (automatically) upon the appointment of Mr.

Kodra in the position of General Director of AME, with Decision no.

02/25 of the Government of the Republic of Kosovo, dated 28.01.2018", the criminal complaint states.

Further in the criminal report it is stated that "on 14.07.2022, the Minister Mr.

Sweden issued Decision no.

0530/2022, through which he appointed the Deputy General Director of AME, Mr.

Shefki Abdullahu, in the position of General Director of AME, until this position is filled according to the relevant legislation in force, a decision which directly affects the work relationship of Mr.

Kodra, therefore, terminates his work relationship, as the General Director of AME, on the one hand, as well as as a public official, on the other hand," the criminal complaint further states.

Kodra's lawyer writes in the criminal report that the damage caused by Sveçla, according to him, exceeds the amount of 5 thousand euros and says that what the Minister of Order has done is punishable by a fine and imprisonment of 3 to 10 years.

In a statement to the Telegraph, lawyer Fetahu announced that he has filed a complaint with the Independent Supervisory Council (KPMShCK).

The same has made it known that regarding this decision of Minister Sveçla, through an email his client Fadil Kodra had also informed Prime Minister Albin Kurti.

In the email that Kodra has sent to Kurti and which Telegrafi has provided, he writes that "Through this email, I inform you that the Minister of Internal Affairs, Mr.

Sweden issued two decisions on July 14, 2022, according to which it claims to illegally terminate my employment relationship as General Director of the Emergency Management Agency.

Sweden issued two illegal decisions, where on the one hand, it issued Decision no.

0529/2022, dated 14.07.2022 (which I received on the same day via e-mail), through which the Decision no.

107/2015, dated 13.03.2015, although in the circumstances of the specific case,

the annulled decision has not been in force for years, since the same was annulled ipso-jure (automatically) on the occasion of my appointment to the position of General Director of AME, while on the other hand, it issued decision no.

0530/2022, dated 14.07.2022, through which he appointed the Deputy General Director of AME, Mr.

Abdullahu, in the position of the deputy General Director of AME, consequently my work relationship (as General Director of AME) has been terminated."

Through this email, Kodra informs Kurt that he has also submitted a complaint to the KPMSHCK.

"While today, I also have to inform you that I filed a complaint with the KPMSHCK, challenging these illegal decisions.

So I filed an appeal against these decisions, an appeal which in terms of Article 130 (Effects of filing an appeal) of Law No.

05/L-031 for the General Administrative Procedure, also suspends the implementation of these arbitrary acts", it is stated in the email that Kodra sent to Kurti.

Kodra had also sent an email to Minister Sveçla where he told him about the impossibility of implementing the decision to dismiss him, and therefore the termination of his employment as General Director of AME.

"If you didn't know, please keep in mind that the right to legal remedies is guaranteed by the Constitution and the law, therefore, in the sense of Article 13 of the above-mentioned law, I used the legal remedies against these decisions in order unprecedented and illegal have violated my interest and right in the work relationship.


In this sense, since the provision of the first paragraph of Article 130, expressly has a suspensive character to the illegal decision, I can implement your decisions only after the final decision is taken by the KPMSHCK, but not earlier, as well as any of your actions after the suspensive effect of the complaint, would constitute another criminal offense," Kodra's email to Sveçle says.
