The most important position in the prosecution system of Kosovo, that of the Chief State Prosecutor, has been left with an acting position for several months now.

Besim Kelmendi continues to exercise the office of Chief Prosecutor.

The seat has remained vacant, as President Vjosa Osmani has not yet decided whether or not to decree the candidate Blerim Isufaj for Chief Prosecutor.

The office of the Presidency briefly told Radio Television Dukagjini that there are still no new developments in this direction.

Just a few weeks ago, this institution stated that they are awaiting the decisions of the Constitutional Court regarding the complaints of the two candidates.

The Constitutional Court rejected these two complaints on July 4.

However, despite this development, President Osmani has not yet decided on Isufaj's decree.

However, Lavdim Makshana from the Kosovo Institute for Justice estimates that the President is within a reasonable deadline.

"Even as the law stipulates, there is no precisely defined time limit for when the Chief State Prosecutor should be decreed or not, but in this case we consider that this deadline has not yet passed and the President is still on time, she is on this deadline reasonable time", said Makshana.

In parallel with the process of electing the Chief Prosecutor, the Ministry of Justice has also started another initiative, that of supplementing and amending the Law on the Prosecutorial Council of Kosovo, which will reduce the number of members of this body from 13 to 7.

This is considered to be one of the reasons why the President is delaying the process of decreeing the Chief Prosecutor.

The chances may be that the President will wait for the amendments to the law, which have gone through two readings in the Assembly of Kosovo, to enter into force in their entirety.

And if this happens, Makshana estimates that the selection of the new Chief Prosecutor would be fairer in the new composition of the KPK.


"The selection of Mr. Blerim Isufaj as a candidate for chief state prosecutor was made from an inadequate composition and with the draft law on the Prosecutorial Council this composition will change and we think that with the new composition it will probably be a fairer process", he added. Makshana.

The PDK has sent the amendments to the Law on the Prosecutorial Council to the Constitutional Court.

The decision of the Constitutional Court is not expected to be taken for some time.
