The ICAC has cracked up a corrupt syndicate suspected of using corruption and fraud to assist members of a Mandatory Provident Fund scheme to apply for early withdrawal of MPF using false supporting documents and statutory declarations.


Some immigration consultants said that since the Chinese Ministry of Foreign Affairs and the Hong Kong Government no longer recognize BNO passports as travel documents and proof of identity since January 2021, many customers can only wait until they reach the age of 1 before they can withdraw their MPF in installments or in one lump sum, resulting in the emergence of unscrupulous intermediaries, who will instigate customers to leave Hong Kong permanently to withdraw MPF early and profit from commissions.

Zhang Jiaxi, director of GCA Immigration Advisors, said that the corruption syndicate that the ICAC recently dismantled was born after the Chinese Ministry of Foreign Affairs and the Hong Kong Government no longer recognized the "so-called BNO passport" as a travel document and proof of identity since January 2021.

He explained that many Hong Kong migrants had to wait until they reached the age of 65 before they could withdraw their MPF in instalments or in one lump sum, and some of them were instigated by unscrupulous agents to falsely claim to leave Hong Kong permanently to apply to the trustee for early withdrawal of MPF, from which the intermediaries concerned could profit from commissions.

Another immigration consultant, founder and chief immigration consultant of Smart2Go immigration platform, Yue Wai Lung, pointed out that if Hong Kong people with BNO immigrate to the UK under the "5+1", if the current HKSAR Government does not recognize BNO passports, the approval result of applying for MPF will not be known until 2025 at the earliest. He also estimated that the Hong Kong government may tighten the policy of applying for early withdrawal of MPF in the future, "which may be necessary to present the document holding permanent residence or pay the price to get it first."

MPF: All trustees are required to do a good job of gatekeeping

The Independent Commission Against Corruption confirmed that the ICAC had earlier taken enforcement action to dismantle a corrupt criminal syndicate suspected of assisting members of a Mandatory Provident Fund scheme to apply for early MPF withdrawal using false supporting documents and statutory declarations through corruption and fraud. So far, 20 persons, including the insurance agent and more than 9 MPF contributors involved in the case, have been arrested on suspicion of contravening section <> of the Prevention of Bribery Ordinance.

The MPFA said it was concerned about the incident and was fully cooperating with the ICAC's enforcement actions to crack down on illegal acts. According to the Board, MPF scheme members applying for early withdrawal of MPF on the ground of permanent departure are required to submit a claim form and relevant documents to the trustee and make a statutory declaration. Under the Mandatory Provident Fund Schemes Ordinance, any person who makes a false or misleading statement to the MPFA or the trustee is a criminal offence and can be prosecuted.

Members of MPF schemes and MPF intermediaries are reminded not to try the law by example, and the Bureau has been liaising closely with the relevant law enforcement authorities and setting up a notification mechanism to deal with any suspicious cases. The MPFA has also required all trustees to formulate internal codes of conduct and risk control measures to do a good job in checkkeeping and follow up on suspicious cases in real time to combat illegal acts.
