The prosecutor's protest and the interested party's complaint against the decision to release the properties of former National Security Ministry (MNS) chief, Major General Akif Chovdarov and former National Security Colonel Salim Mammadov from confiscation were considered.

According to the news obtained by APA, the decision was announced in the process chaired by judge Rashad Abdulov.

According to the decision, the cassation protest was granted.

The decision of the Baku Court of Appeal dated December 22, 2022 was annulled, as the issue of the release of property from special confiscation was resolved in violation of substantive and procedural legal norms.

In relation to the prisoners - Akif Chovdarov and Salim Mammadov, it was decided to return the criminal case to the appellate court for a new trial in order to review the issue related to the special confiscation of property in accordance with the requirements of the criminal and criminal procedural legislation.

At the same time, the cassation appeal of the victim and civil plaintiff Jafar Safarov was also granted.

The complaint of Habib Aliyev, the lawyer of Chingiz Asadov, an interested person in the case, was partially satisfied.

It should be noted that Akif Chovdarov and Salim Mammadov were arrested in 2015.

By the verdict of the Baku Military Court, Akif Chovdarov was sentenced to 12 years and Salim Mammadov to 11 years.

Akif Chovdarov was released under the amnesty order signed in 2020, and Salim Mammadov was released under the amnesty order signed in 2022.

In December 2022, the Baku Appellate Court made a decision to release the 30 million worth of property belonging to Akif Chovdarov's relatives and return it to its owners.

Apart from that, Salim Mammadov's properties were exempted from special confiscation.
