The grounds, legality, term and conditions of detention, ensuring the rights of detained persons, and the duties of law enforcement agencies in this regard are determined by national legislation as well as international norms.

APA reports that this was reflected in the "Report of the Human Rights Commissioner (Ombudsman) of the Republic of Azerbaijan for 2022", which was discussed at today's meeting of the Human Rights Committee of the Milli Majlis.

It was mentioned in the document that during the visits, 2 people were detained in the investigative room of the 15th Police Department of the Sabunchu District Police Department without an arrest protocol, and at the same time, at the Temporary Detention Center of the Khazar District Police Department, the person was detained for more than 48 hours, contrary to the requirements of the procedural legislation, as well as the Shamkir District Police It was found that the person detained in the temporary storage place of the department was not brought to the court on time, thereby violating the requirements of the legislation, and appeals were made to the Ministry of Internal Affairs of the Republic of Azerbaijan regarding those cases.

According to the criminal procedure legislation, the reasons for the arrest or detention, as well as the nature of the suspicion or accusation, the right not to testify and to receive legal assistance from a defense attorney must be communicated to each arrested or detained person in a language that is clear to him.

During the visits, monitoring was also carried out on whether the relevant procedural terms were observed in relation to the persons detained on legal grounds.

It was noted that during the inspection conducted at the Sabunchu District Police Department, it was found that the person was detained for more than 48 hours, according to the arrest protocol drawn up by the chief investigator of the 15th Police Department of the department.

During another visit to the 12th Police Department of the Sabunchu District Police Department, it was determined that the arrest of the person lasted for four days and during this period he was kept in the investigation room.

The reason given by the MSY was that the person who received 30 days of administrative detention was not accepted by the Detention Center for Administrative Detainees due to the lack of a relevant doctor's opinion due to the lack of a COVID-19 test result.

However, it was determined that information about his release (sent) on the date of his detention was recorded in the "Registration Book of Persons Brought to City, District, and Line Police Authorities".

In some cases, there are cases where entries are made with a simple pen in the relevant registration book of the police authorities, which allows for violations of the law, such as easily changing those entries later.

At the same time, there were cases of restriction of the right to freedom of debtors based on relevant court decisions regarding debt claims by police authorities, and cases of unjustified detention by the police.
