According to the project, an emergency environment of a social nature is a result of emergency situations that cause or may cause disruption of the living conditions of the population in the entire territory of the Republic of Azerbaijan or in individual parts, including the death of people, significant damage to the health of the population, property or the environment. is an environment that arises, but is not considered a basis for the application of an emergency state.
The emergency environment regime of a social nature is a special legal regime that ensures the immediate and interconnected implementation of measures by state bodies (institutions) related to the elimination of the emergency environment without limiting the exercise of human and civil rights and freedoms.
The emergency environmental regime of a social nature is applied in the entire territory of the Republic of Azerbaijan or in separate parts by the normative legal act of the relevant executive authority.
The normative legal act on the introduction of the social emergency environment regime should be immediately announced in the media, including official publication within 24 hours.
The period of application of the emergency environmental regime of a social nature cannot exceed the period of elimination of the emergency situations that were the basis for the application of this regime.
Measures to eliminate the emergency environment of a social nature are also defined.
With the exception of measures that limit the exercise of human and civil rights and freedoms, during the application of the emergency environment regime of a social nature, it implements all necessary measures to eliminate that emergency environment, including providing assistance to the victims.
Measures to eliminate the emergency environment of a social nature are carried out in accordance with the Constitution of the Republic of Azerbaijan, this Law, other normative legal acts and international agreements to which the Republic of Azerbaijan is a party, within the limits arising from the severity of the emergency environment.
A commission (headquarters) composed of representatives of the relevant state bodies (institutions) is established by the relevant executive power body for the immediate and interconnected implementation of measures to eliminate the emergency environment of a social nature.
The order of activity of the commission (headquarters) for eliminating the social emergency environment is determined by the relevant executive authority.
Officials of state bodies (institutions), local self-government bodies, all legal entities of the Republic of Azerbaijan, citizens of the Republic of Azerbaijan, foreigners and stateless persons in the Republic of Azerbaijan must comply with the rules of conduct established when the emergency environmental regime of a social nature is applied,
they must perform the duties assigned to them on time and, if necessary, provide assistance in the implementation of emergency-rescue and other urgent works undertaken to eliminate the emergency situation of a social nature.
Citizens of the Republic of Azerbaijan, foreigners and stateless persons in the Republic of Azerbaijan have the right to receive complete and objective information about the necessary security measures taken in the area where the social emergency environment regime is applied.
During the application of the emergency environmental regime of a social nature, the types and procedure of implementation of measures to eliminate the emergency environment and the procedure for creating, using and restoring state resources are determined by the relevant executive authority.
After discussions, the draft law was recommended to the plenary session of the parliament.
