Pursuant to Article 1.0.1 of the Law on the Circulation of Narcotic Drugs, Psychotropic Substances and Their Precursors, drugs are included in the United Nations Convention on Narcotic Drugs of 1961 and the Convention on Psychotropic Substances of 1971. , The Convention on Combating Illicit Trafficking in Narcotic Drugs and Psychotropic Substances of 1988, as well as the lists approved by the Law of the Republic of Azerbaijan.

However, the notion of “drugs” reflected in Article 234.1 of the Criminal Code, which is in force, should also include plants containing narcotic substances.

This has led to some difficulties in practice, including the improvement of legislation on the illegal collection, storage and transportation of narcotic plants (parts thereof) or other means under Article 234.1 of the Criminal Code, as well as the purpose of sale.
