Delhi's Rouse Avenue Court sends Satyendar Jain to ED custody till June 9 in money laundering case

New Delhi :

The Delhi High Court has reserved its verdict on the Enforcement Directorate's (ED) plea in the custody of Delhi Health Minister Satyendar Jain.

During the interrogation of the trial court, the decision on challenging the condition of presence of Jain's lawyer was reserved.

After hearing the arguments of both the sides, the court reserved the decision.

During the hearing, the ED's counsel told the Delhi High Court that there is no point in staying with the lawyer during the interrogation of Delhi Minister Satyendar Jain in the money laundering case through hawala.

They are arrested in this case but Raju argued that though Jain has been arrested, he is not an accused. Hence he will not get the rights which are available to the accused persons.

In such a situation, how can they claim the facilities available to the accused, it is not proper. 

On this, advocate Abhishek Manu Singhvi, appearing for Satyendra Jain, said that if Jain is not the only accused, then why has he been taken into custody? Why is he not providing facilities for the presence of a lawyer during his interrogation as an accused? This is an abuse of the process of law.

They should follow the law.

It should be dismissed with fine.

In fact, the Delhi High Court had agreed to hear the ED's petition soon.

The ED has filed a petition in the Delhi HC saying that the presence of a lawyer during Jain's custodial interrogation will make no sense for Jain's ED custody.

Delhi's Rouse Avenue Court has sent Satyendra Jain to ED custody till June 9 in the money laundering case.

The court, on the request of Jain's counsel, had allowed the lawyer to be present during the custodial interrogation and said that he could see but not hear the process of interrogation from a distance.
