Farmers are obliged to keep records of the quantities and types of fertilisers, soil improvers, biologically active substances and food substrates placed on the market without CE marking, as well as of the quantities and types of EU fertilising products used. This is envisaged by amendments to the Plant Protection Act adopted at second reading by Parliament. The full bill was not allowed to be voted on.
Fertilisers, soil improvers, biologically active substances and food substrates placed on the market without CE marking, as well as EU fertilising products, are stored and transported in compliance with fire and explosion safety requirements in a way that excludes damage to human, animal and environmental health.
The Executive Agency "Bulgarian Accreditation Service" is designated as a notifying authority responsible for establishing and conducting the assessment procedures, for notifying conformity assessment bodies and for monitoring notified bodies. The obligations of economic operators relating to the provision of documents and information to plant protection inspectors are outlined. Penalties have been introduced for violations of the requirements.
The Bulgarian Food Safety Agency (BFSA) has been designated as the market surveillance authority for fertilising products.
Farmers ready to protest again if they do not receive money in the coming days
For entry in the register of products meeting the requirements of the law, the persons submit to the head office of the BFSA an application form, in which they indicate the UIC under the Commercial Register Act and the register of non-profit legal entities or the identification number for registration of persons registered in another Member State of the European Union or in a country, party to the Agreement on the European Economic Area.
Within three months of the submission of the application, the Executive Director of the BFSA or an official authorized by him with an order shall enter in the register the requested product or refuse the entry on a reasoned basis.
