The shareholder of Ukrnaftoburinnya, the British group JKX Ukraine B.P., demands not to transfer the assets of Ukrnaftoburinnya to Ukrnafta.

The company also requires Ukrnafta to refuse to take over the management of these assets.

This is stated in the letter of the company's lawyer to the Cabinet of Ministers, Ukrnafta and the Ministry of Defense, UNIAN reports.

The letter also requires the National Agency for Finding, Tracing and Management of Assets (ARMA) to recognize as of May 26 any exceptional circumstances specified in paragraphs 1 and 2 of part 1 of Art. Art. 21(1) of the Law on ARMA, according to which a decision was made to transfer the assets of Ukrnafta. Lawyers note that such circumstances did not exist and could not be. Therefore, there was no reason to decide on the transfer of assets.

The letter notes that in accordance with part five of Article 21-1 of the Law on ARMA, it is determined that the decision of the Cabinet of Ministers on the transfer of assets into management in connection with an exceptional case should contain a justification for the need to apply the peculiarities of transferring assets into management provided for in this article, however, the draft order and the explanatory note to it do not contain information about the existence of risks of failure and / or interruption of the functioning of such assets.

"Unfortunately, as of 26.05.2023, neither the shareholders of PJSC "PC "Ukrnaftoburinnya" nor the PJSC "MC "Ukrnaftoburinnya" had the opportunity to get acquainted with the justification for the application of the provisions of Art. 21-1 of the Law on ARMA of the peculiarities of transferring assets into management, which should be given by ARMA in its letters to the Cabinet of Ministers of Ukraine dated 19.04.2023 No. 4494/1-9-23/6 and dated 10.05.2023 No. 5774/6.1.2 – 9-23/6," the text of the letter says.

Earlier, one of the largest gas producing companies in Ukraine, Ukrnaftoburinnya, appealed to NABU to investigate the transfer of seized assets of the company to the management of PJSC Ukrnafta.
