Lawyers for the U.S. government pointed out in a document filed in Manhattan federal court on Monday that many crypto companies will fail during the crypto winter of 2022, and FTX is among them.
However, the U.S. government filed a lawsuit against SBF less than a month after FTX went bankrupt, without waiting and following the normal civil and regulatory procedures, not only that, but also inappropriately trying to turn these civil and regulatory issues into federal crimes. Fang's move was "typical of a hasty judgment".
U.S. prosecutors have until May 29 to respond to SBF's request to dismiss, the report said.
Then, U.S. District Judge Lewis Kaplan will hear arguments June 15 in Manhattan federal court.
